Punta Gorda Fence & Deck provides residential and commercial deck building, fence installation, screened porch construction, pergola installation, and related outdoor structure services in Punta Gorda, FL and surrounding communities. Services are provided on a project basis following a signed written agreement. We do not guarantee availability and reserve the right to decline any project at our discretion.
All free estimates provided by Punta Gorda Fence & Deck are based on information available at the time of the on-site consultation. An estimate is not a binding contract. Prices are subject to change based on final project scope, material availability, site conditions discovered after work begins, or changes requested by the client.
A binding agreement requires a written, signed contract specifying the project scope, materials, price, and timeline. Work does not begin until a written contract is executed and any required deposit is received.
Project start dates are estimates and may be affected by permit approval timelines, weather conditions, material lead times, or other factors outside our control. We will communicate any schedule changes as soon as they are known.
If you need to cancel or reschedule a project, please notify us in writing at least 5 business days before the scheduled start date. Cancellations made after a permit has been applied for or after materials have been ordered may result in forfeiture of your deposit or additional fees to cover actual costs incurred.
We reserve the right to cancel or suspend work if site conditions are unsafe, if payment obligations are not met, or if permits or inspections cannot be obtained.
Payment terms are specified in your written project contract. Typical payment schedules include a deposit due at contract signing, a progress payment at a defined project milestone, and a final payment due upon project completion and client acceptance.
All invoices are due in full upon receipt unless otherwise stated in writing. We accept payment by cash, check, or electronic transfer. We reserve the right to charge interest on balances that remain unpaid beyond 30 days of the due date at the maximum rate permitted by applicable law.
If collection efforts are required due to non-payment, you agree to be responsible for all reasonable collection costs, including attorney fees.
You agree to provide us with accurate and complete information about your property, including any easements, utilities, HOA restrictions, or site conditions that could affect the project. Failure to disclose known conditions may result in additional costs or delays that are your responsibility.
You are responsible for obtaining HOA approval where required before work begins, unless we have agreed in writing to assist with that process. We are not responsible for project delays caused by HOA review timelines.
Where required by law, we will apply for and obtain the necessary building permits before starting work. Permit fees are either included in your written contract or billed at cost. Work requiring permits will not begin until those permits are issued. We are not responsible for delays caused by government permitting offices or inspection scheduling.
We warrant that all work will be performed in a workmanlike manner and in accordance with applicable building codes. Any warranty terms specific to your project will be stated in your written contract.
Manufacturer warranties on materials - including composite decking, railing systems, and fasteners - are pass-through warranties subject to the manufacturer's terms and conditions. We make no additional representations regarding manufacturer warranties.
Our warranty does not cover damage caused by misuse, neglect, unauthorized modifications, natural disasters, severe weather events, or normal wear and tear. The content on our website is provided for informational purposes only and does not constitute a warranty of any kind.
To the fullest extent permitted by applicable law, Punta Gorda Fence & Deck shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Site, your reliance on information on our Site, or any services we provide.
In no event shall our total liability to you for any claim arising from or related to our services exceed the total amount you paid us for the specific project giving rise to the claim.

If informal resolution is not possible, disputes arising from our services shall be resolved through binding arbitration administered under the rules of the American Arbitration Association, unless both parties agree in writing to another method. The arbitration shall take place in Charlotte County, FL. Nothing in this section prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Charlotte County, FL.
You may use our Site for lawful purposes only. You agree not to reproduce, distribute, or exploit any content from our Site without our prior written permission. We make no guarantee that the Site will be available at all times or free of errors, and we reserve the right to modify or discontinue any part of the Site at any time.
